Welcome to Kendra Aldrich Art. By accessing or using this website (https://www.kendraaldrich.com) and purchasing custom artwork, ornaments, or merchandise, you agree to be bound by the following Terms of Service. Please read them carefully before placing an order.

1. Overview & General Conditions

  • This website is operated by Kendra Aldrich Arts. Throughout the site, the terms “I”, “me”, “my”, and “studio” refer to Kendra Aldrich.

  • By placing an order or using this site, you confirm that you are at least the age of majority in your state or province of residence.

  • I reserve the right to refuse service or cancel an order to anyone for any reason at any time (e.g., in cases of suspected fraud or abusive behavior).

2. Custom Artwork & Commission Terms

Because custom portraits and hand-painted ornaments are personalized works of art created specifically for you, custom orders are subject to the following rules:

  • Reference Photos: For custom artwork, you must supply clear, well-lit reference photos following the guidelines specified on the product or commission page. I am not responsible for inaccurate fur colors or missing physical details caused by dark, blurry, heavily filtered, or low-resolution reference photos.

  • Artistic Interpretation: All custom pieces are hand-painted in my signature artistic style. Minor variations in color, layout, brushwork, and natural wood texture are an inherent part of handmade original art and are not considered defects.

  • Digital Proofing & Approval:

    • Custom ornaments and select portrait commissions include a digital proofing check prior to production/shipping.

    • You will be notified via email to review your proof. Please respond within the requested timeframe (e.g., 48 hours for ornaments).

    • Delays in approving proofs will shift your estimated completion and shipping timeline.

  • Order Abandonment: Custom canvas orders that remain unfulfilled due to client non-responsiveness (failure to submit photos, approve proofs, or respond to communications) for more than 1 year from the date of purchase are subject to termination without a refund.

3. Pricing & Payment

  • All prices are listed in USD. I reserve the right to modify pricing for future products or custom commissions at any time without prior notice.

  • For large canvas commissions over $300, split payment options (e.g., 50% deposit upfront and 50% upon completion) may be arranged upon request.

  • Full payment is required at checkout for standard shop products and custom ornaments.

4. Refunds, Cancellations & Returns

  • Custom Artwork (Final Sale): Because custom portraits and ornaments are personalized specifically to your pet, all sales on custom artwork are final once painting or production has begun.

  • Damaged or Incorrect Items: If your physical order arrives damaged in transit or contains an error on my end, please contact me via email within 5 days of delivery (or within 48 hours for ornaments) with photographs of the packaging and item so I can facilitate a replacement or repair.

  • General Merchandise: Returns or exchanges for non-custom store items are handled on a case-by-case basis within 5 days of receiving your item. Return shipping costs are the responsibility of the buyer unless the item arrived damaged.

5. Shipping & Delivery

  • All items are carefully packaged and shipped from Bellingham, Washington via USPS, UPS, or FedEx.

  • Shipping Addresses: You are responsible for providing an accurate and complete shipping address at checkout. Kendra Aldrich Art cannot be held responsible for packages delayed, lost, or misdelivered due to an incorrectly entered address.

  • Delivery Estimates: Stated completion and shipping timelines (e.g., 6–8 weeks for custom canvases, 2–4 weeks for ornaments during holiday peaks) are estimates and not guaranteed delivery dates. External carrier delays (weather, holiday congestion) are outside of my control.

6. Intellectual Property & Copyright

  • Artist Ownership: Kendra Aldrich retains all reproduction rights and copyrights on all original artwork created, including custom commissions, portraits, and ornament designs.

  • Promotional Use: I retain the right to showcase photographs, digital proofs, and video process clips of custom artwork on my website, portfolio, social media channels, and promotional materials.

  • Personal Use: Clients receive physical ownership of the artwork for personal use (e.g., displaying in your home or sharing photos on personal social media accounts with credit to Kendra Aldrich).

  • Commercial Restriction: You may not reproduce, scan, resell, print, or use any artwork or design for commercial purposes without prior written consent from Kendra Aldrich.

7. Limitation of Liability

Kendra Aldrich Art shall not be liable for any indirect, incidental, or consequential damages resulting from the use of this site, delivery carrier delays, or the purchase and display of any physical artwork.

8. Governing Law

These Terms of Service and any separate agreements shall be governed by and construed in accordance with the laws of the State of Washington, United States.
